Terms of Service - Mobile Hearing Solutions
Effective Date: November 10, 2025
1. Services
Mobile Hearing Solutions provides mobile hearing-care in the DFW area (and telehealth). Website content is educational only; a licensed provider determines diagnosis/treatment. We may sell hearing aids and accessories online now or in the future; some devices may require professional evaluation/fitting.
2. Eligibility
You must be 18+ (or age of majority) to use the site/purchase without a parent/guardian.
3. Online hearing tools
Any screening or questionnaire is informational and not a diagnosis.
4. Appointments & mobile visits
Provide a safe environment for our providers at your location and comply with applicable laws. Telehealth involves electronic communications; you consent and acknowledge inherent risks despite reasonable safeguards.
5. Orders, pricing, availability
Prices/promotions/availability may change. We may limit orders by jurisdiction to meet regulatory requirements and may refuse/cancel suspected fraudulent or non-compliant orders.
6. Shipping, returns, exchanges
We will display shipping timelines and any trial/return windows at checkout or in store policies. Unless otherwise stated: unopened accessories returnable within 30 days; hearing-aid returns/trials may involve professional fees or state-law rules. You are responsible for return shipping unless prohibited by law.
7. Payments
You authorize charges to your selected method for purchases, fees, and taxes. Third-party processors handle payments; we do not store full card details.
8. Insurance & benefits verification
By submitting your information, you authorize us to verify eligibility/benefits with insurers and to share necessary info with them. Sometimes we use only basic identifiers (name, DOB, member ID); other times, additional PHI may be necessary. See the HIPAA Notice.
9. Acceptable use
No unlawful, infringing, defamatory, obscene, or harmful activity. No reverse engineering, scraping, or interference with site operation.
10. IP rights
Site content, trademarks, and logos are our property or our licensors’. No reproduction or distribution without written permission.
11. Privacy & HIPAA

12. Third-party services
We may integrate or link to third-party tools (scheduling, forms, payments). We are not responsible for their services.
13. Disclaimers
SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
14. Liability limits
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS. TOTAL LIABILITY WILL NOT EXCEED AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM OR $100 IF NONE.
15. Disputes, governing law, venue
Texas law governs. Exclusive venue lies in the state and federal courts in Dallas County, Texas. We may mutually agree in writing to binding arbitration administered by a recognized provider.
16. Changes
We may update these Terms by posting a new effective date. Continued use means acceptance.
